Dear Cyndy, Thank you for your welcome e-mail. We arrived at 7:15 p.m. after an uneventful two-day trip. I've unpacked the car and gone out for groceries. There are many things still to put away. I'll try tomorrow morning, after I return from taking Klemens to his office, to start working on my legal reply brief. The AG has not filed a brief, but has written a letter to the Appeals Court Clerk stating that I was wrong when I wrote that he had conceded the case when he failed to file an opposition to my motion for judgment on the pleadings in the Superior Court. The AG now says that he/shex didn't really concede because although he filed a notice of appearance for the Plumbing Board he/she was only their "nominal" representative; in other words, he represented the Plumbing Board not really but in name only, - al this after masquerading as the Board's attorney all through the lower court proceeding. If a private attorney did such a thing, he would be charged with fraud upon the court, - but remember 1984 has come and gone, and the government does what it pleases. I had an e-mail notice from the Supreme Judicial Court clerk to the effect that my application for direct appellate review has been denied, a circumstance which reduces my chances of success from 40% to 16%. I must practice getting comfortable and happy with the notion of losing the case. Another stage of living and dying. I'm afraid that for the next two weeks, all you'll read from me are notes on my case, in effect the initial drafts of my reply brief. As soon as I've finished with that, I'll get back to real life.
