Although the distinction between testamentary and non-testamentary
bequests is well established, purporting to bequeathe by will what
has already been assigned by a non-testamentary instrument (the
trust),  creates ambiguity concerning the trustor's and testators
intention, - an ambiguity which might be used to challenge the
validity of the trust assignment.
