Dear Mr. Pucci, With respect to our telephone conference scheduled for Monday, February 7, 2011, at 10:30 a.m. 1) I would like to prepare a written record of our conference, to submit to you for your correction and endorsement. We should at minimum be able to agree about what we have said to each other. 2) You have my permission to make an electronic recording of our conversation, provided: a) you inform me in advance that you are making such a recording, and b) that you provide me with an unedited copy of any recording that you make. 3) Although I have available the equipment to make an electronic recording of our conversation, I will NOT make such a recording unless you request me by e-mail to do so. If you do make such a request and if I am successful in making an electronic recording, I will furnish you, at no cost, an unedited copy on CD. 4) My wife who has been closely involved in the Nantucket construction project will listen to our conference on an extension 'phone. She is 87 years old and partially deaf. 5) I will prepare as detailed an account of our conversation as I am able. I will submit this account to you and request your corrections and your endorsement. 6) I will then make a motion that this account which you have had the opportunity to correct and/or endorse be docketed and filed with SUCV2008-05664. I hope you are having a pleasant weekend. I very much look forward to our conversation. Sincerely, Ernst Meyer
