Thank you for your letter. The information is very valuable. You have found conclusive evidence that the Trust is not dry, but is funded. You must now decide whether you wish to comply with Marion's request that you accept the trusteeship. If the answer is "yes", then Marion should make formal resignation as trustee by signing the following statement, witnessed if possible by three individuals and dated. "I Marion Namenwirth of 1627 Carl Street, St. Paul, MN, hereby resign as sole trustee of the Marion Namenwirth Trust Agreement dated December 11, 2015." At the same time, your dated signature to the following might be witnessed if possible by three individuals, "I, Klemens B. Meyer, 178 School Street, Belmont MA, hereby accept and assume the sole trusteeship of the Marion Namenwirth Trust Agreement dated December 11, 2015, pursuant to Article 5.2 of that document." However, your acceptance does not require Marions presence and could be deferred until you are back in Belmont. My suggestion is that you bring with you to Belmont the originals or clear legible copies a) of documentation from Sunrise Bank, Affinity Credit Union and Woodbury Financial Services, each of which is captioned as reflecting income to the Marion Namenwirth Trust of 12-11-2015, b) the quitclaim deed to the Wisconsin Farm, and c) the 2016 Income Tax returns With Marion's written witnessed resignation as Trustee and the documented existence of Trust Accounts at Sunrise Bank, Affinity Credit Union and Woodbury Financial Services it should be possible to negotiate by mail from Belmont the recognition of your signature as successor Trustee, and my judgment is that you need not protract your stay in Minneapolis to negotiate this recognition in person. The new trust accounts which I suggested no longer seem necessary to me. The document of Marion's written witnessed resignation however is essential. I believe that all other paperwork can be taken care of from Belmont (by me, if you wished). A copy of the "TOD deed" and the name and e-mail address of the lawyer who drafted it would be useful but not essential. If I were you, I wouldn't delay my return to Belmont in order to find them. The original quitclaim deed will contain the information on the basis of which I can draft a deed, to be signed by you as Trustee after Marion's death transferring Marion's interest in her Farm to Felicia Ananda Lawrence Macindoe. That deed, mailed to Felicia Ananda Lawrence Macindoe would discharge your obligations to beneficiaries as Trustee (and as Executor, if the Will were probated.) Please give Marion my Best Wishes.
