In the issue of annual inspections, the DMV contradicts itself in that it classifies driving an uninspected car to be a "moving violation", while it also exploits its electronic records to charge uninspected cars parked on private property with a "moving violation." e) The significance of a "moving violation" is that it effectively augments the statutory penalty of $40 by permitting the insurance company enhance their profits by levying an annual 20% surcharge for 6 years. It is unclear whether the statutory $40 penalty and/or the potentially much higher insurance penalty is applicable to the owner, to the driver or to both. f) To blunt public anger at its petty tyranny, the DMV invites "appeals" from aggrieved drivers. Such appeas are said to be granted asa matter of course. There is no catalogue of the basis on which such appeals have been granted in the past either by the DMV or by the insurance companies g) Plausible basis for an appeal might be g1) Refusal of AAA to move uninspected vehicle to inspection station g2) Vehicle is registered to Belmont. g3) Owner was physically unable to take vehicle to inspection station g4) Insufficient number of inspection stations on Nantucket: Ack 1 station for summer population of 80,000. Ratio: 1:80000 MA 1800 stations for population of 6,985,000. Ratio: 1:3880.55 g5) Nantucket would require 20.6165 times as many stations as it has to make statewide standards applicable.
