Both the criminal and the civil law present remarkable
stages (Buehnen) on which the premises of ethics are acted
out day after day and year after year, and one ought, as a
matter of principle, to demand of all ethical theoreticians
that they begin their expositions with an account of what
happens in court, or at minimum that they reconcile their
claims and theories with what happens in court.
============
A related and very important topic is the relationship
between the law (and regulation) and the ethical imperative.
whether it is good to obey, and bad to disobey a regulation;
whether and in what way the laws themselves may be good or
bad, and whether it is bad to enact and/or enforce a bad
law; and whether it is good to enact and or enforce a good
law. [more on this tomorrow, und villeicht auf deutsch]
